Canadian Rehabilitation

For those who wish to enter Canada, having a criminal record can seriously impede your travel intentions to Canada.

Many people attempt to cross the border to Canada on a daily basis. Some people, when crossing, are not even aware that they are considered criminally inadmissible. It is only after a startling and sometimes embarrassing situation at the border, when dealing with a border official, that they become painfully aware of their status.

For those of you have been denied entry to Canada because of a previous criminality, an Application for Criminal Rehabilitation may be just the answer you are looking for.

While a Temporary Resident Permit can be understood as the temporary alleviation of inadmissibility, Criminal Rehabilitation Permanently overcomes that inadmissibility so you will never face issue at the border again.

There are two ways to qualify for Criminal Rehabilitation; being Deemed Rehabilitated and applying for Individual Rehabilitation.

Deemed Rehabilitation is the understanding that after 10 years of completion of your conviction, with no re-offenses of any kind, it is unlikely that you will commit another crime. This is an automatic change and does not require the submission of an application. However, it is also highly subjective and at the discretion of an Officer making a decision. For this reason, it is recommended that you still file a formal application to have confirmation of your Deemed Rehabilitation to avoid any unnecessary difficulty when travelling.

The other option is applying for Individual Rehabilitation which you are only eligible for after five years since the completion of your sentence with no further offenses.

With this application, you will need to demonstrate the changes you have made towards your overall wellbeing as well as your remorse. You will also need to have sufficient grounds for seeking rehabilitation, meaning, your reason for entering Canada.

A Immigration Officer must weigh your need to enter vs. the risk you may pose should you be allowed to enter. For this reason, strongly demonstrating your need to enter Canada is also important aside from the other basic requirements of this application type.
