The Temporary Resident Permit was intended for individuals who have criminal inadmissibility, but cannot apply for a Criminal Rehabilitation yet. In most cases, many of the individuals who apply for a Temporary Resident Permit have a legitimate reason for their entry into Canada. However, as the name states, the individual can only enter Canada temporarily; it does not overcome the criminality permanently. A Temporary Resident Permit can be valid for one day or up to three years. This entirely is in the hands of the Immigration officer that is examining the application. It is important to note that the Immigration officer will consider the reasoning for entering Canada when issuing the authorization period of a Temporary Resident Permit. When applying for a Temporary Resident Permit, you can either apply at the port of entry or at the Canadian consulate. This also depends on how urgent you need to travel to Canada. However, applying at the Canadian consulate is highly regarded by Immigration officers as it shows that the individual is serious about overcoming their criminal inadmissibility.
There are several documents that are required when applying for a Temporary Resident Permit. It is essential that individuals provide Immigration with these documents because, if not, their application can be either returned or refused and they would have to start the process all over again. Therefore, in order to successfully apply for a Temporary Resident Permit, you must submit the following documents:
In order to further explain the importance of these documents, I will explain in detail below why they are required.
This is most definitely the most important documents that you must submit for a Temporary Resident Permit. These documents must be submitted in their original form. The only exception to this rule is if you are applying for a Temporary Resident Permit at the port of entry. In some circumstances, the police clearances can also be referred to as State Clearances or FBI Clearances, for Americans. If you are coming from another country, other than the United States, you will require the National Police Clearance and the local police clearances to show your criminal record on file. In other words, you will need these documents to show Canadian Immigration your criminal record, what you were convicted for and whether the charges were dismissed, etc. When applying for a Temporary Resident Permit, it is essential that you provide police clearances from anywhere you have lived for over 6 months since the age of 18. Please note that the duration does not have to be continuous – if you have lived somewhere for two months, left and then came back for another four months, you will need a clearance from that place. The validity of the police clearance is for one year but in most cases Immigration officers still not accept police clearances that are from six months before the submission of the application.
It is very important to provide your identity documents, such as a copy of your passport data page and your driver’s license in order to show Canadian Immigration who you are and your personal information. Without submitting this, your Temporary Resident Permit will more than likely be refused. The reason why this is required is because this will be the document that you will use to enter and leave Canada. Therefore, it is very important to remember to keep your passport valid. If it will expire soon, the Immigration officer can only issue the Temporary Resident Permit until the passport expires. So, depending on how long you wanted the Temporary Resident Permit, you will be only issued a time within the validity of your passport. In order to avoid these circumstances, it is best to verify the validity of your passport before applying for a Temporary Resident Permit and, if you would like, renew your passport.
Court documents are essential to the Temporary Resident Permit application as they support the police clearances. For information that is not listed in the police clearances, the court documents will most likely have. Court documents would include court judgements made against you, the description of the charge laid, the section of the law under which the charge was laid, the verdict, the sentencing, and more. It could potentially include payment of fines, the dates in which the sentence was completed and other details that happen after the implementation of the charge. Therefore, submitting these documents are necessary for the Immigration officer to fully understand your criminal inadmissibility.
