A foreign national may be inadmissible for immigration to Canada on the grounds of criminality and those grounds are following:
For convictions within Canada, if you have:
- If you been convicted in Canada of an indictable offence punishable by a sentence less than ten years; or
- You have been convicted in Canada of two or more summary offences;
For convictions outside Canada, if you have:
- If you been convicted of an offence outside Canada that, if committed in Canada, would be equivalent to indictable offence punishable by a sentence of less than ten years; or
- If you have been convicted outside Canada of two or more acts that, if committed in Canada, would be equivalent to summary offences; or
- If you have been convicted of outside Canada of two or more acts that, if committed in Canada, would be equivalent to hybrid offence punishable by a sentence of less than ten years.
For criminal acts committed outside Canada, if you have:
- If you have committed an offence that, if committed in Canada, would be equivalent to an indictable offence punishable by a sentence of less than ten years.
If you are currently charged with or previously convicted of any kind of criminal offence inside or outside of Canada may be prohibiting from visiting, working, studying or applying for permanent residence in Canada. Even some traffic violation can also make you inadmissible. The following examples of convictions which can make you inadmissible to Canada are:
- Driving under the influence
- Driving with ability impaired
- Theft
- Petty theft/Larceny (shoplifting)
- Assault
- Disorderly conduct
- Obstruction of justice
Like criminality, serious criminality is also make inadmissible to you if you have convicted to crime and factors are almost same as criminality. You as foreign national or permanent resident may be criminally inadmissible or removable from Canada, as the case may be, on the grounds of serious criminality and factors of serious criminality is similar to criminality.
