Denied Entry to Canada for Inadmissibility on Record

Reasons you can be Denied Entry to Canada

When you wait over an hour at the border crossing, the last thing you want to do is listen to an officer telling you that you are a criminal and that you are denied entry into the country because of your past conviction(s). As shocked and as angry you may be, there is nothing you can do other than to get a TRP, be deemed rehabilitated by meeting the legal requirements, get a temporary resident permit, or be granted a record suspension. Something as big as a murder offence to something as small as your medical condition that could possibly impose threats upon other citizens can get you denied entry into a country. At Akrami & Associates, we know how frustrating it is to be denied entry and if you choose us, our skilled and experienced staff will help defend you case based on your circumstances and we will do our best in making sure that you are granted entry into the country. As we always say at Akrami & Associates, there is always a way!

What is a Temporary Resident TRP?

A temporary resident is a person whom is not a Canadian citizen but is residing legally in Canada for a limited time due to his or her own circumstances. TRP is an abbreviation for “Temporary Resident Permit”. A temporary resident permit is a makeshift permit that grants you entry into a country no matter what previous offences or threatening conditions you may have. Evidently, depending on the severity of your offence, the immigration or border officer will provide you with a certain time frame in which you are allowed entry into the country for. With a temporary resident permit, you are also entitled to travelling in and out of the country simultaneously during the time frame that the officer provides you with. Depending when you completed your offence you may be eligible to apply for a Criminal Rehabilitation. Criminal Rehabilitationis a document that helps overcome your inadmissibility for permanent basis if you meet the requirements. To be eligible to apply for criminal rehabilitation five years must have passed since the offence was completed.

How to get a TRP

In order to obtain a TRP you have to prove to the officer that you will not pose threats to Canada nor its citizens due to your offence or condition. If you abuse the power of a TRP, the immigration or border officer can cancel your temporary residence permit at any time using their judgment skills. There are many documents you need to include in your application when applying for a TRP. Documents are crucial to your application process because if you are missing one, your request for a TRP may end up failing. Unfortunately, many people get declined entry into a country and are shocked at the outcome. In most cases the reason that their TRP application failed is just because they are missing a document. In applications there is no such thing as an “important document” due to the fact that they are all equally important. Without a single document, your whole application becomes useless. At Akrami and Associates, our experienced and knowledgeable staff will help with your application process and ensure that there are no missing documents when you choose to work with us.

When can you NOT apply for a TRP?

If you enter Canada and are denied entry it is likely because you do not have a TRP. If you apply for a TRP, you may be surprised when you find out that you cannot obtain one. If you are denied a TRP it is likely that you are a really big threat to the country and its citizens due to the fact that whatever crime you may have committed was extremely illicit and/or did not rehabilitate from that criminal offence. Another circumstance in which you may be declined a TRP is if your medical condition poses a serious threat to the country and its citizens as well. If you think that you are not capable of entering the country based on your past crimes and offences, our skilled associates can help defend you by helping you understand the legality of your situation and winning your case by being granted entrance.

How much does a TRP cost?

A temporary resident permit costs $200 which is a reasonable price if you are desperate to get into a country and have no time to stop and talk to various officers about your situation. Something to keep in mind is that if you do end up paying the mandatory $200 fee for your temporary resident permit (TRP), you still run the chance of being denied. If you are denied a TRP there are no refunds. At Akrami & Associates our number one priority is to help our clients with whatever barriers they are facing and do our best to remove those barriers. As for the cost attached, we have many options and depending on the financial circumstances of our clients, we will do our absolute best to tailor the price of the TRP to our clients’ needs.
