Authorization to Return to Canada

If you have been granted permission to enter Canada and you have been given legal immigration status, you have to keep in mind that entry into Canada is a privilege. As a condition to this privilege, you are required to follow the law of Canada, as well as the conditions and requirements associated with your legal immigration status. Failure to comply with Canadian law, any conditions or requirements imposed on you by Citizenship and Immigration Canada, and/or the Immigration and Refugee Protection Act or Regulation, can result in your removal from Canada.

There are different types of removal orders that can be issued to you. Your eligibility to apply for an Authorization to Return to Canada will depend on the type of removal order that you have been issued. One of the removal orders that you can get is a deportation order.

Deportation Order

If you are given a deportation order it means that you are banned from coming back to Canada permanently.

If you have been issued a deportation order, you are required to submit an application for Authorization to Return to Canada in order to be given permission to re-enter Canada. Your Authorization application will need to include the following, in addition to other considerations:

  • The reasons you feel you should be able to return to Canada
  • If you had a departure order that turned into a deportation order, you must include the reasons why you failed to comply with the departure order and leave Canada.

 

Another thing you have to consider when you are issued a deportation order is the reason you were issued a deportation order in the first place. If you were issued a deportation order because of a criminal inadmissibility, you will need to apply for criminal rehabilitation first before you can apply for an Authorization to Return to Canada. You will also need a Temporary Resident Permit to enter Canada.

With a deportation order, like other removal orders, you need to confirm your departure from Canada with the Canada Border Service Agency. Failure to do so, can have consequences to your application for Authorization to Return to Canada.

Departure Order to Deportation Order

In some instances you may be given a departure order, but this departure order can become a deportation order. A departure order becomes a deportation order when you, after being issued a departure order, fail to comply with the order and leave Canada, or you leave Canada without confirming your departure with the Canada Border Service Agency.

Therefore, although you may be anxious when you receive a departure order, you need to follow the requirements of the order. If not, your departure order can become a deportation order.

You first need to ensure that you follow the instructions of a given order before you consider whether you can apply for an Authorization to Return to Canada. If you fail to comply with a removal order, this can hinder or complicate your Authorization application.
